These Terms & Conditions apply to photography services provided by Kaya Dawkins Photography (“the Photographer”, “I”, “me” or “my”).
By confirming a booking and paying the required booking fee, you (“the Client”) agree to these Terms & Conditions. Please read them carefully before proceeding with a booking.
1. Services & Booking
I provide photography services including personal branding, portraits and event photography.
The specific services, session duration, number of final images, location, price and any additional deliverables will be confirmed with you before your booking.
A booking is not confirmed and the date is not reserved until the required 50% booking fee has been received, unless otherwise agreed in writing.
Any additional services or deliverables requested after booking may incur an additional charge, which will be agreed before they are provided.
2. Booking Fee & Payment
A 50% booking fee is required to secure your session date and time.
The remaining 50% balance must be paid before the final edited gallery is delivered, unless different payment terms have been agreed in writing.
Final edited images will not be released until all outstanding amounts relating to the booking have been paid.
Payments may be made by bank transfer, invoice payment method or another method agreed between the Photographer and Client.
3. Cancellation
If you need to cancel your booking, please notify me in writing as soon as possible.
The booking fee compensates for reserving the agreed date and for reasonable preparation and administration undertaken in connection with the booking.
Where a Client cancels, I may retain some or all of the booking fee to the extent reasonably necessary to cover losses arising from the cancellation, including time already spent preparing for the session and the loss of the reserved booking date.
Where appropriate, any amount retained will be reasonable and proportionate to the circumstances of the cancellation.
If I am able to substantially mitigate the loss, this will be taken into consideration.
Nothing in these Terms affects any cancellation or refund rights you may have under applicable consumer law.
4. Rescheduling
Please provide as much notice as possible if you need to reschedule your session.
Rescheduling requests made less than 24 hours before the scheduled session may incur a £25 rescheduling fee.
A new date will be subject to my availability.
Repeated rescheduling or a substantial change to the agreed booking may be treated as a cancellation and new booking.
If a session needs to be rescheduled because of severe weather, illness, venue closure or another circumstance outside either party's reasonable control, I will work with you to arrange an alternative date where reasonably possible.
5. Client Lateness
Please arrive on time and ready for your session.
If you arrive late, the session will normally still finish at the originally scheduled time so that other commitments and bookings are not affected.
Additional shooting time is not guaranteed and, where available, may be subject to an additional fee.
Significant lateness that prevents the session from reasonably proceeding may be treated as a Client cancellation.
6. Travel, Parking & Additional Costs
Travel, parking, venue hire, studio hire, permits and other third-party costs are not included unless specifically stated in your package or quotation.
Any additional costs that I expect the Client to cover will be communicated and agreed before the session wherever reasonably possible.
Where unexpected costs arise during a shoot at the Client's request, these may be invoiced separately.
7. Locations, Permissions & Access
Unless otherwise agreed, the Client is responsible for ensuring that photography is permitted at the chosen location and for obtaining any necessary permissions, permits or venue approvals.
The Client is also responsible for providing reasonable access to any private property or venue required for the session.
I am not responsible for delays, restrictions or inability to photograph caused by a Client's failure to obtain the necessary permission or access.
Where a location becomes unavailable, I will make reasonable efforts to adapt the session or agree an alternative where practical.
8. Client Responsibilities & Cooperation
The Client agrees to provide accurate information relevant to the booking and to cooperate reasonably during the session.
While I will provide guidance and direction where appropriate, the Client remains responsible for their own clothing, styling, hair, makeup, props and personal belongings unless these services have specifically been included.
I cannot guarantee specific poses, expressions, backgrounds, weather conditions or an exact recreation of reference or inspiration photographs.
9. Proof Gallery & Image Selection
Where the selected package includes Client image selection, a proof gallery will be provided after the session.
The Client may select the number of final images included within their package. Additional images may be purchased separately where available.
Proof images are provided for selection purposes only. They are not final edited photographs and must not be downloaded, screenshot, published, shared publicly, edited or used commercially.
Only the final edited images supplied by Kaya Dawkins Photography are licensed for Client use.
10. Editing & Retouching
Final photographs are edited in my established photographic style.
Editing may include adjustments to exposure, colour, contrast, cropping and reasonable retouching where appropriate.
Creative and editing decisions remain at my professional discretion.
Requests for extensive retouching, manipulation or alterations beyond my standard editing process may incur an additional charge. This will be communicated before additional work is undertaken.
11. RAW & Unedited Files
RAW files, unedited photographs and rejected images are not supplied as part of any standard photography package.
The Client is purchasing the finished photographic work rather than every image captured during the session.
12. Image Delivery
Unless otherwise agreed, final edited photographs will normally be delivered within 7–10 business days following the Client's final image selection.
Delivery times are estimates and may vary during particularly busy periods or where circumstances outside my reasonable control cause a delay.
If a different turnaround has been agreed for a particular booking, the agreed timeframe will apply.
Final images will normally be delivered through an online gallery.
13. Copyright
Copyright in photographs created by Kaya Dawkins Photography remains with the Photographer in accordance with applicable copyright law unless copyright has expressly been transferred in writing.
Payment for photography services does not constitute a transfer of copyright.
Instead, the Client receives a licence to use the final delivered images in accordance with the agreed purpose of the booking.
14. Client Image Usage
For portrait/personal photography, final images may be used for the Client's personal purposes, including personal social-media accounts and personal printing.
For personal-branding and business photography, the Client may use the final images to promote themselves and/or the business for which the session was commissioned, including on their website, organic social media, professional profiles, email marketing, presentations and other agreed business communications.
Images must not be substantially edited, recoloured, filtered or otherwise altered in a way that misrepresents the Photographer's work without prior written permission. Reasonable cropping and resizing for different platforms is permitted.
15. Third-Party & Advertising Usage
Unless otherwise agreed, the Client's licence does not automatically grant unrelated third parties the right to use, reproduce, license or commercially exploit the photographs.
If photographs are required for third-party advertising, paid campaigns, product packaging, resale, licensing, publication or another use outside the originally agreed purpose, please contact me so that the appropriate usage can be agreed.
Editorial press/publication relating directly to the Client or their business may be permitted where consistent with the original purpose of the commission.
16. Photographer Portfolio & Marketing
I may wish to display photographs from sessions in my portfolio, website, social-media channels, awards, printed portfolio and marketing materials.
Where appropriate, Clients will be given the opportunity to communicate privacy requirements or restrictions relating to publication.
Where the Client has expressly requested that photographs remain private, I will respect that agreement.
For confidential, embargoed or unreleased projects, the Client should notify me before the session or before providing confidential materials so that appropriate arrangements can be agreed.
17. Events & Other Participants
For event photography, the Client is responsible for informing attendees where appropriate that photography will be taking place and for communicating any relevant photography restrictions to me before or during the event.
I will make reasonable efforts to respect requests not to photograph particular individuals where these are clearly communicated.
The Client is responsible for obtaining any permissions specifically required for their intended use of photographs featuring event attendees.
18. Safety & Conduct
I reserve the right to pause or end a session where I reasonably believe that continuing would place me, the Client, participants, members of the public or equipment at risk.
Abusive, threatening, discriminatory, harassing or otherwise inappropriate behaviour will not be tolerated.
Where a session is ended because of serious Client or participant misconduct, amounts already paid may be retained to the extent reasonable in light of the services already provided and losses incurred.
19. Equipment Failure, Data Loss & Photographer Illness
I take reasonable precautions to protect equipment and image files, including appropriate storage and backup practices.
In the unlikely event that photographs are lost, corrupted or unusable because of equipment malfunction, data failure or another circumstance outside my reasonable control, I will where reasonably possible offer an appropriate remedy, which may include a reshoot, partial refund or refund.
Where the entire photographic service cannot be provided and a reshoot is not reasonably possible, my liability will ordinarily be limited to the amounts paid for the affected photography service, subject always to rights that cannot lawfully be excluded or limited.
If I become unable to attend because of serious illness, emergency or another unavoidable circumstance, I will contact the Client as soon as reasonably possible and offer rescheduling or another appropriate remedy.
20. Circumstances Outside Our Control
Neither party will be responsible for a failure or delay caused by circumstances outside their reasonable control, including severe weather, transport disruption, venue closure, government restrictions, emergencies or similar events.
Where this occurs, both parties will make reasonable efforts to rearrange the session or find an appropriate alternative.
21. Limitation of Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to the above and applicable consumer rights, I will not be responsible for indirect or consequential losses that were not reasonably foreseeable when the booking was made.
Nothing in these Terms affects the Client's statutory rights.
22. Changes to a Booking or Agreement
Any material changes to an agreed booking — including the scope of work, location, duration, deliverables or usage requirements — should be agreed in writing.
I may update the general Terms & Conditions displayed on my website from time to time. However, the terms applicable to an existing confirmed booking will be those accepted in connection with that booking, together with any later changes mutually agreed in writing.
23. Consumer Rights
Nothing in these Terms is intended to restrict rights provided to consumers by applicable law.
Where mandatory consumer-law rights apply, those rights take precedence over any conflicting provision in these Terms.
24. Governing Law
These Terms are governed by the laws of England and Wales.
The courts of England and Wales will have jurisdiction, subject to any mandatory rights a consumer may have to bring proceedings elsewhere.
